CHICAGO PSYCHOANALYTIC SOCIETY CPS DIGITAL ARCHIVES ACCESS & USER AGREEMENT -FOR SOCIETY MEMBERS ONLY-
1. Purpose of Access & Use In accordance with the mission of the Chicago Psychoanalytic Society (“CPS” or “Society”) to advance the field of psychoanalysis through education and research, the Society provides secure, remote digital access to archival materials for the purpose of supporting scholarly research, education, and the preservation of the Society’s institutional history. All references to “materials,” “archival materials,” “CPS materials,” or “Society archives” shall mean the “CPS Digital Archives.” Access is granted to CPS members only and is subject to strict confidentiality, ethical, and legal safeguards. Use of the Society archives shall be for personal and educational purposes only. 2. Eligibility & Authentication Access is limited to current CPS members in good standing. Each CPS member is issued individual login credentials for the Society website for personal use only and must agree to the terms of use set forth herein to access the CPS Digital Archives. Individual login credentials may not be shared, transferred, or used by any third party. CPS reserves the right to suspend or terminate access for violations or security concerns. 3. Scope of Digital Materials Member access may include selected digitized institutional records, historical correspondence, photographs, lectures, and Society publications. The majority of the CPS Digital Archive consists of professional papers given by local, national, and internationally renowned psychoanalysts. Materials containing protected clinical material and personal information are generally excluded. 4. Confidentiality & Protected Information Members acknowledge that the professional papers in the CPS Digital Archive may contain sensitive personal or clinical references even when anonymized. Users agree not to attempt to identify any patient, analysand, or private individual; not to disclose identifying information in any form; to maintain anonymity in all scholarly, educational, or public use; and to comply with applicable privacy laws, including HIPAA where relevant, and with professional psychoanalytic ethical standards. 5. Nature of Access (Read-Only) All materials are provided on a primarily read-only, view-only basis. No copying, downloading, saving, transmitting, or reproducing is permitted without explicit written authorization from the Society Archivist or the CPS Executive Committee. 6. Note-Taking (Permitted) Members may take personal handwritten or typed notes derived from on-screen viewing for private scholarly and educational use. Notes may not contain identifying clinical information or verbatim reproductions of restricted or copyrighted materials. 7. Member-Only Use & Non-Transferability Actual content may not be shared, forwarded, uploaded, posted, displayed, or distributed to any non-member of the Society, except for educational purposes. Materials may not be used for forensic, legal, evaluative, or commercial purposes. 8. Prohibition on Downloading, Saving & Local Storage Society members may not download, save, store, or create copies of any archival material without written authorization. 9. Screenshots, Screen Recording & Photography Screen capture, screen recording, or photography of CPS archival materials is prohibited without prior written permission of the Society Archivist or Executive Committee. 10. AI, Data-Mining & Automated Tools The use of CPS archival materials for artificial intelligence training, text mining or extraction, automated analysis or scraping, or uploading CPS materials is strictly prohibited. 11. Permitted & Prohibited Uses Permitted uses include on-screen viewing, personal note-taking, and education and scholarly research. Prohibited uses include commercial exploitation, media publication, public web posting, or public presentation without written authorization. 12. Copyright & Intellectual Property CPS does not necessarily own copyright in all holdings. Members are responsible for determining copyright status and securing publication permissions. 13. Citation & Attribution All scholarly use of the CPS Digital Archive must credit: Chicago Psychoanalytic Society Archives, Chicago, Illinois. 14. Platform Security & Monitoring CPS reserves the right to monitor system usage to ensure compliance with this Agreement and to investigate suspected violations. 15. Violations & Sanctions Any violation of this Agreement may result in immediate revocation of access, referral for Society disciplinary action, and potential legal consequences. 16. Disclaimer of Accuracy CPS archival materials are provided “as is” with no warranty of completeness or accuracy. 17. Indemnification & Liability Limitation Society members agree to indemnify and hold harmless CPS and its representatives, officers, committee members, employees, and volunteers from claims arising from the misuse of archival materials. 18. Term, Amendments & Governing Law This Agreement becomes effective upon first access and may be amended at any time, and any changes made to this Agreement will take effect immediately upon posting. and is governed by the laws of the State of Illinois. 19. DMCA Compliance CPS complies with the Digital Millennium Copyright Act of 1998 (“DMCA”). CPS has adopted a policy providing for the termination, in appropriate circumstances, of members who are repeat infringers of copyrighted works. CPS responds promptly to valid notices of alleged copyright infringement that comply with DMCA 20. DMCA Notice-and-Takedown Procedure If you believe in good faith that archival materials hosted by CPS infringe your copyright, you may send CPS a notice requesting that the material be removed, or access to it be blocked. The notice must include the following information: (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing or the subject of infringing activity, and the information reasonably sufficient to allow CPS to locate the material in the archive; (d) the name, address, telephone number, and email address (if available) of the complaining party; (e) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, the DMCA permits you to send CPS a counter-notice. Notices and counternotices must comply with the DMCA’s statutory requirements. Notices to CPS should be sent via email to chicagoPS.webmaster@gmail.com. 21. Anti-Circumvention of Digital Protections Society members may not bypass, disable, override, interfere with, or otherwise circumvent any security measures, access controls, digital rights management (DRM), download restrictions, watermarking systems, or technological protection measures used by CPS to protect its digital archival materials. Any such circumvention constitutes a material breach of this Agreement. |
